Annex 1 - Mandatory Conditions
The restrictions on the times during which the licence authorises the sale by retail of alcohol on the premises, set out in part M of the Licensable Activities section of this licence do not prohibit:
(a) consumption of the alcohol on the premises or the taking of sale or supply of alcohol to
Any person residing in the licensed premises;
(b) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of
the alcohol so ordered;
(c) the sale of alcohol to a trader or club for the purposes of the trade or club;
(d) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or
supply of alcohol is carried out under the authority of the Secretary of State or an
authorised mess of members of Her Majesty’s naval, military or air forces;
(e) the taking of alcohol from the premises by a person residing there; or
(f) the supply of alcohol for consumption on the premises to any private friends of a person
residing there who are bona fide entertained by him at his own expense, or the
consumption of alcohol by persons so supplied; or
(g) the supply of alcohol for consumption on the premises to persons employed there for the
purposes of the business carried on by the holder of the licence, or the consumption of
liquor so supplied, if the liquor is supplied at the expense of their employer or of the
person carrying on or in charge of the business on the premises.
No supply of alcohol may be made under the premises licence:-
(a) at a time when there is no designated premises supervisor in respect of the premises
licence,
or
(b) at a time when the designated premises supervisor does not hold a personal licence or
his personal licence is suspended.
Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
No person under fourteen shall be in the bar of the licensed premises during the permitted hours unless one of the following applies:
(a) He is the child of the holder of the premises licence.
(b) He resides in the premises, but is not employed there.
(c) He is in the bar solely for the purpose of passing to or from some part of the premises
which is not a bar and to or from which there is no other convenient means of access
or egress.
(d) The bar is in railway refreshment rooms or other premises constructed, fitted and
intended to be used bona fide for any purpose to which the holding of the licence
is ancillary.
In this condition “bar” includes any place exclusively or mainly used for the supply and consumption of alcohol. But an area is not a bar when it is usual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals.
Intoxicating liquor shall not be sold or supplied on the premises otherwise than to persons taking table meals there for consumption by such persons as an ancillary meal.
Intoxicating liquor shall not be sold or supplied on the premises otherwise than to persons residing there or their private friends bona fide entertained by them at their expense and for consumption by such persons so entertained by them either on the premises or with a meal supplied at but to be consumed off the premises.
There shall be afforded in the premises for persons provided with board and lodgings for reward adequate sitting accommodation in a room not used or to be used for sleeping accommodation, for the service of substantial refreshment or the supply or consumption of intoxicating liquor.
Suitable beverages, other than intoxicating liquor, including drinking water shall be equally available for consumption with or otherwise as an ancillary to meals served in the premises.
Intoxicating liquor shall not be sold or supplied otherwise than to persons attending bona fide functions organised other than by the licensee or his representative.
Annex 2 - Conditions Consistent with the Operating Schedule
A personal licence holder shall be present on the premises at all times.
Staff shall be given appropriate training in respect of licensing issues, including under age drinking and drug policies to the standards required by relevant legislation.
A suitable level of Illumination shall be provided to the car park and exterior of the premises.
The premises shall be equipped with a closed circuit television system covering the entrance, car park, bar area and kitchen.
All staff on and around the grounds shall be equipped with walkie-talkies.
The number of persons permitted in the function rooms shall be restricted to 300.
Appropriate emergency lighting and fire escape routes shall be maintained for the premises.
Staff shall be fully trained in fire procedures.
All equipment shall be regularly tested on a regular maintenance programme.
Suitable first aid facilities for both staff and customers shall be maintained at the premises.
Music from a DJ or bands shall be monitored by means of an ADB metre and kept to a reasonable level.
DJ’s and bands shall be required to sign a music control form.
Appropriate notices shall be displayed from the premises requesting customers to leave quietly with respect for local residents when leaving the premises.
An appropriate risk assessment for the building and grounds shall be conducted.
All areas of danger shall be clearly identified by means of a clear notice.
Annex 3 - Conditions attached following a hearing by the Licensing Authority
All doors and windows on the premises shall be closed after 9.00pm while licensable activities are taking place.
The premises shall have a ventilation or air conditioning system capable of providing a comfortable environment within the building while it is in operation with all doors and windows closed.
At all times when recorded or amplified music is being provided on the premises, such music shall be subject to an automatic noise limitation device (or other suitable device) the device being set to reduce the level of sound if the volume reaches a pre-set level. Such level to be to the reasonable satisfaction of the Environmental Health Authority.
