ANNEX 1 - MANDATORY CONDITIONS
1.1 No supply of alcohol may be made under this licence
a. At a time when there is no designated premises supervisor in respect of it or,
b. At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended
1.2 Every retail sale or supply of alcohol made under this licence must be made or by a person who holds a personal licence.
1.3 The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
2.1 There shall be written training policies and formal training programmes in place to ensure staff our equipped to meet the licensing objectives.
2.2 All training and revision/refresher materials shall be reviewed regularly.
2.3 Management shall be trained to support the running of the premises including looking after customers and staff.
2.4 All staff shall be trained and regularly refreshed in the corporate “Think 25”Policy. Staff shall be trained to look at the customer and “Think 25” when selling alcohol.
2.5 A till prompt shall appear on the initial sale of alcohol that shall remind the seller of their responsibilities including not to sell alcohol to anyone under the age of 18.
2.6 The store shall display signage around the premises informing both staff and customers of the “Think 25” policy on alcohol.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
3.1 The Licence holder is to support and rigorously enforce the Challenge 25 proof of age policy. All staff shall be trained to ask any person who they believe looks or appears to be under the age of 25 to provide identification that they are over the age of 18 to purchase alcohol. The following are forms of identification that are acceptable:
a) Photo driving licence
b) Passport
c) Proof of Age Standards Scheme Card
d) National ID card
3.2 All staff shall receive suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this shall be made available to an authorised officer upon request. Refresher training shall be conducted every 6 months as a minimum.
3.3 Ordinarily a member of management team shall be on the premises at all times the premises are open to the public. In exceptional circumstances where this is not the case another member of staff shall be given responsibility of the premises and all staff shall have knowledge of who this person in responsibility is.
3.4 CCTV shall be installed internally at the premises and will comply with the following:
a) The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. Many areas of the premises are to be covered by the system including the entrance/exit checkout and main alcohol display. The system will be capable of providing an images which is regarded as identification standard.
b) The system shall display on any recording the correct time and date of the recording.
c) The system shall make recordings during all hours the premises are open to the public.
d) VCR tapes or digital recording shall be held for a minimum of 21 days after the recording is made and will be made available to the Police or any authorised persons acting for a Responsible Authority for inspection upon request.
e) The system shall, as a minimum, record images of the head and shoulders of all persons entering the premises.
3.5 A staff member who is conversant with the operation of the CCTV system shall be on the premises at all times the premises are open to the public. This staff member shall be able to show recent data or footage with the absolute minimum of delay when requested to a Police Officer or to a Local Authority Enforcement Officer.
3.6 If the CCTV is not working correctly the licence holder shall take immediate steps to rectify the fault. A log of the steps shall be kept and be made available for inspection Police Officer or to a Local Authority Enforcement Officer.
3.7 Appropriate signage alerting customers to CCTV recording shall be displayed in conspicuous positions on the premises.
3.8 An authorisation of sales, signed and dated by the DPS, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises.
3.9 An incident book shall be maintained, in which shall be recorded:
Refused sales to suspected under age/ drunken persons.
That book shall be available for inspection by a Police Officer or authorised person.
