• ANNEX 1 - MANDATORY CONDITIONS

   

  No supply of alcohol may be made under this licence

  a.              At a time when there is no designated premises supervisor in respect of it or,

  b.              At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended

   

  Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence.

   

  The admission of children under the age of 18 to film exhibitions permitted under the terms of this licence shall be restricted in accordance with any recommendations made:

  a.              By the British Board of Film Classification (BBFC), where the film has been classified by that board, or

  b.              By the Licensing Authority where no classification certificate has been granted by the BBFC, or, where the Licensing Authority has notified the licence holder that Section 20(3)(b) [Section 74(3)(b) for clubs] of the Licensing Act 2003 applies to the film.

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  Non-Standard Timings

  The following additional permitted hours apply to the Provision of regulated entertainment (Categories: B, C, E, F, G, H, I, J & K) and Supply of Alcohol:

  1        From 11:00 on 31st December until 11:00 on 1st January.

  2        The terminal hours for all above licensable activities to be extended until 01:00 the following morning, in respect of the following days:

           Friday, Saturday, Sunday for each Easter Bank Holiday, Spring Bank Holiday and August Bank Holiday weekend.

           Christmas Eve, Boxing Day and New Years Day.

   

  The following additional permitted hours apply to in respect of the opening hours of the premises:

  1        From 11:00 on 31st December until 11:00 on 1st January.

  2        Until 01:30 the following morning, in respect of the following days:

           Friday, Saturday, Sunday for each Easter Bank Holiday, Spring Bank Holiday and August Bank Holiday weekend.

           Christmas Eve, Boxing Day and New Years Day.

   

  Exceptions to permitted hours

  The above restrictions do not prohibit:

  ()       consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;

  ()       the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;

  ()       the sale of alcohol to a trader or club for the purposes of the trade or club;

  ()       the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;

  ()       the taking of alcohol from the premises by a person residing there; or

  ()       the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of  alcohol by persons so supplied; or

  ()       the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.

   

  The Prevention of Crime & Disorder

  1        The Designated Premises Supervisor, when present, and all members of staff will ensure that all lawful instructions and/or directions given by the Police are complied with.

  2        No person in possession of a drink in a sealed or unsealed container will be allowed to enter the premises except for the purposes of delivery.

  3        Adequate provisions will be made to prevent unauthorised access to the storage of empty bottles.

  4        The premises will be operated in participation with the ‘Pub-watch’ scheme.

  5        No drink will be removed from the premises in an unsealed container.

   

  Public Safety

  6        All parts of the premises will at all times be kept free from defect and no structural changes or alterations on any part of the premises will be made without the prior approval of the Council.

  7        All exits and escape routes to the exits (including external escape routes) from the premises will be provided with non-slip even surfaces and will be maintained in good repair, correct working order and kept free from all obstructions when the public are on the premises.  External escape routes will also be kept free from ice and snow.

  8        All doors or gates both inside and outside the premises which are on an escape route will be fitted only with approved fasteners and will at all times be properly maintained, free from obstruction and be capable of being opened easily and fully so that they do not restrict the public leaving the premises and will open in the direction of the escape route.

  9        All exit doors and gates from premises or enclosure(s) surrounding it will be capable of being opened by any person without the use of a key, card, code or other similar means and be kept free from all fastening devices when the premises are open to the public.

  10   All exit routes and doors on such routes will be checked at regular intervals when the premises are open to the public to ensure that they are free from defect, obstruction, trip hazards and surfaces are not slippery. 

  11   The method of opening any exit door or gate from the premises or enclosure(s) surrounding it will be clearly displayed immediately above or below the fastening in white block lettering on a green background in letters not less than 50 mm high.

  12   Where a fire-resisting door is fitted within the premises and that door is required to be kept closed at all times then the door will be clearly marked on both sides with a sign bearing the words "FIRE DOOR KEEP CLOSED" in block letters not less than 50mm high and clearly visible when the premises are open to the public.

  13   Any door or gate in the premises which is not an exit door or gate will have a sign bearing the word "PRIVATE" in block letters not less than 50 mm high.

  14   Any chain, padlock or any other device used to lock an exit door when the premises are not in use  will be removed when the premises are open to the public.

  15   The furniture or seating in premises will be arranged so that it does not obstruct any exit, route to any exit or to any facility within the premises.

  16   Where any furnishing or fitting in the premises including wall, floor and ceiling linings, requires further periodic treatment to maintain the surface spread of flame qualities, they will be treated in accordance with the manufacturers specifications. 

  17   No curtain, hanging or any other decoration will be positioned so as to obstruct any exit, sign or fire fighting equipment.

  18   Notices will be prominently displayed in the premises detailing the essential steps that must be taken if a fire is discovered or the fire alarm goes off or other emergency arises and how to call the Fire Service.

  19   A person who is nominated for the purpose of taking control in the event of a fire, fire alarm, emergency or event which may effect the safety of persons attending the premises will be on and in charge of the premises at all times when any licensable activity is being provided.  That person will be responsible for calling the Fire Service in the event of any fire and that person will also be responsible for meeting the Fire Service and guiding them to the fire.

  20   Any outbreak of fire of any kind will be reported to the Fire Service immediately.

  21   Clear and unobstructed access will be available to the premises for use by the emergency services and emergency service vehicles at all times.

  22   There will be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials.

  23   When the public are present, the lighting levels in all parts of the premises will be capable of providing sufficient illumination for them to leave the premises safely .The lighting level will be maintained by an emergency lighting system which will automatically operate when the electricity supply to the main lighting is interrupted.

  24   Regular inspection of all normal and emergency lighting will take place. All faults discovered will be repaired immediately or if that cannot be done then as soon as is possible.

  25   The premises will be provided with adequate lavatory accommodation which will at all times when the premises are in use be kept clean, ventilated, disinfected and supplied with hot and cold water, soap, toilet tissue, hand drying and sanitary towel disposal facilities as appropriate.

  26   No explosive, liquefied petroleum gas or any other highly flammable materials will be used or stored on the premises unless notified to the Licensing Authority and is used in accordance any guidance given by Lancashire Fire and Rescue Service. 

  27   No pyrotechnics including fireworks will be used or stored at the premises unless notified to the Licensing Authority and they are used in accordance with any guidance given by Lancashire Fire Service.

  28   No dry ice machines or cryogenic fog, smoke machines or fog generators will be used at the premises unless notified to the Licensing Authority and used in accordance any guidance given by Lancashire Fire Service.

  29   Lasers will only be used on the premises in accordance with the requirements for the safe use of lasers as set down in the HSE Guide, The Radiation of Safety Lasers Used for Display Purposes [HS (G) 95] and BS 60825: Safety of Laser products British Standard 4803: part 3.

   

  The Prevention of Public Nuisance

  30   No nuisance will be caused by noise coming from the premises or by vibration transmitted through the structure of the premises.

  31   A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents will be displayed at the exit from the premises.

  32   Refuse such as bottles will be disposed of from the premises at a time when it is not likely to cause a disturbance to residents in the vicinity of the premises.

  33   No light from or on the premises and any other light under the control of the premises will be provided where that light causes a nuisance to any nearby premises.

   

  The protection of children from harm

  34   There will be in place for the premises a policy to prevent the sale or supply of alcohol to persons under 18 years of age.  That policy will require any person who appears to be under the age of 21 years to produce a recognised proof of age card accredited under the Proof of Age Standards Scheme (PASS) or if a proof of age card is not available a photo driving licence or passport indicating that they are over 18 years of age.

  35   Accompanied children under 16 will be permitted in the bar areas in line with the provisions of the licensing act 2003.

  36   A notice or notices will be displayed in and at the entrance to the premises where they can be clearly seen and read and will indicate that it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.

• ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY

   

  The prevention of Crime and Disorder

  1        The premises are operated in accordance with the principles outlined by the ‘Nightsafe’ Scheme, as are relevant to those premises, and indicated in the associated leaflet.

  2        All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.

  3        An adequate number of Licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the ‘Nightsafe’ Scheme.

  4        Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the  licensed premises.

  5        All beer glasses will be progressively replaced with those of toughened glass and from 31st December 2006, Only toughened glass vessels are to be used to dispense beer to customers.

  6        At least one personal licence holder will be available while the supply or sale of alcohol is being undertaken (who’s identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.

  7        Risk assessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.

  8        Records of incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection.

  9        Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.

  10   During the final hour of daily trading appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents and to advise patrons of any taxi free-phone or collection arrangements available upon the premises.

  11   The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.

  12   Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
