Annex 1 - Mandatory Conditions
No supply of alcohol may be made under this licence
a. At a time when there is no designated premises supervisor in respect of it or,
b. At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended
Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence.
The admission of children under the age of 18 to film or video exhibitions permitted under the terms of this licence shall be restricted in accordance with any recommendations made by
(a) The British Board of Film Classification (BBFC) where the film has been classified by that Board, or
() The Licensing Authority where no classification certificate has been granted by the BBFC or where the licensing authority has notified the licence holder that section 20 (3) (b) of the Licensing Act 2003 applies to the film
Annex 2 - Conditions consistent with the Operating Schedule
The maximum number of persons permitted in the parts of premises below shall be restricted to::
Auditorium only (theatre seating) - 453 + 4 allocated wheelchair spaces
Auditorium and studio combined (open floor with tables and chairs) - 350
Studio (theatre style) - 150
Studio (clear floor) - 100
Studio (Dances with tables and chairs) - 80
Green Room Bar, tables and chairs - 50
Admission shall be controlled by ticket purchase from the Box Office.
There shall be in place for the premises a policy to prevent the sale or supply of alcohol to persons under 18 years of age. That policy will require any person who appears to be under the age of 18 years to produce a recognised proof of age card accredited under the Proof of Age Standards Scheme (PASS) or if a proof of age card is not available a photo driving licence or passport indicating that they are over 18 years of age.
Notices shall be displayed in and at the entrance to the premises where they can be clearly seen and read and will indicate that it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.
There shall be displayed at the entrance to the premises a sign, which is clearly visible to those visiting the premises containing details of the hours which the hotel shall be open to the public, the licensable activities permitted on the premises and the maximum occupancy level set for the premises.
No person in possession of a drink in a sealed or unsealed container shall be allowed to enter the premises except for the purpose of delivery.
No alcoholic beverage shall removed from the premises in an unsealed container.
A payphone telephone shall be provided on the premises to allow patrons to contact local taxi companies for transportation from the premises if required.
There shall be in place arrangements for the safe evacuation of all patrons and hiring companies to the venue, including those persons with disabilities.
All hirers shall be made aware of the safety and evacuation arrangements upon their booking of the venue by issue of Fylde Borough Councils published “Terms and Conditions of Hire of Lowther Pavilion”.
All parts of the premises, shall at all times, be kept free from defect and no structural changes or alterations on any part of the premises shall be made without the prior approval of the Council.
All exits and escape routes to those exits from the premises shall be kept clear of obstruction, both inside and outside the premises at all times, provided with non-slip even surfaces and will be kept in good repair and correct working order. They shall be capable of being opened easily and fully so as not to restrict the public leaving the premises.
All doors which are on an escape routes shall be fitted only with approved fasteners and be capable of being opened by any person without the use of any key, card, code or similar means and be kept free from all fastening devices when the premises are open to the public. The method of opening any exit door from the premises shall be clearly displayed immediately above or below the fastening in white block letters on a green background in letters not less than 50mm high.
All fire resisting doors within the premises shall be kept closed at all times unless fitted with automatic release devices and will be clearly marked on both sides with a sign bearing the words “FIRE DOOR KEEP CLOSED”. Doors fitted with automatic release devices shall be kept closed whenever the premises are not in use.
Any chain, padlock or any other device used to lock an exit door when the premises are not in use shall be numbered and stored on a hook bearing the same number and all exit routes and doors will be checked before the premises are opened to the public.
Where any furnishing or fitting in the premises including wall, floor and ceiling linings requires further periodic treatment to maintain the surface spread of flame qualities, they shall be treated in accordance with the manufacturers specifications.
No curtain, hanging or any other decoration shall be positioned so as to obstruct any exit, sign or fire fighting equipment.
Printed notices shall be displayed at the Stage Managers desk, lighting and sound control and in the Box Office detailing the steps to be taken by the relevant people in the case of discovery of fire, the fire alarm sounding or other emergency arising.
The duty Fylde Borough Council member of staff shall take control in the event of any fire or emergency event, which may effect the safety of persons attending the premises.
The duty staff member shall be responsible for ensuring the premises have been fully evacuated, that the fire service has been summoned and shall meet the Fire Service at the main entrance guiding them to the occurrence.
An automatic calling system shall be installed for calling the Fire Service when the alarm sounds.
Where the water supply to any hydrant, hose reel or drencher system is cut off or restricted, the Fire Service shall be notified immediately.
Clear and unobstructed access shall be available to the premises for use by the emergency services and emergency service vehicles at all times.
There shall be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials.
Whenever the premises are open to the public, the lighting levels in all parts of the premises shall be capable of providing sufficient illumination for them to leave the premises safely. The lighting level shall be maintained by an emergency lighting system, which shall automatically operate when the electricity supply to the main lighting is interrupted.
All emergency exits shall be illuminated so that they can be easily read at all times when the public are on the premises.
The controls for the emergency lighting shall be protected from unauthorised use and accidental operation, and the system designed so that the emergency lighting cannot be altered.
The emergency lighting and fire alarm system shall be maintained in a fully operational condition at all times and tested and inspected regularly. All faults discovered shall be rectified immediately, or if that cannot be done, then as soon as practically possible.
All stage equipment, both electrical and mechanical shall be maintained in a fully operational condition at all times in accordance with current legislation and tested and inspected regularly. Any faults discovered shall be rectified immediately, or if that cannot be done, then as soon as practically possible.
No temporary electrical installation shall be installed on the premises unless the installation is carried out by a suitably qualified person and a certificate of fitness for purpose, complying with BS7671 and where applicable BS7909 is supplied to the Premises Supervisor.
All electrical equipment brought into the venue in connection with any hiring shall comply with the “Regulations for the Electrical Equipment of Buildings” and shall carry a current test certificate in accordance with regulation 4 of the Electricity at Work Act 1989.
No smoking or naked flame shall be permitted on any part of the stage during any entertainment unless that use has been notified to the Licensing Authority and is provided in accordance with guidance with by the Lancashire Fire and Rescue Service. Any smoking materials used onstage shall be of a herbal base.
There shall be no smoking permitted in the premises, apart from as referred to in the above condition.
No explosive, liquefied petroleum gas or any other highly flammable materials shall be used or stored on the premises unless notified to the Licensing Authority and is used in accordance any guidance given by Lancashire Fire Service.
No dry ice machines or cryogenic fog, smoke machines or fog generators shall be used at the premises unless notified to the Licensing Authority and used in accordance any guidance given by Lancashire Fire Service.
No pyrotechnics including fireworks shall be used or stored at the premises unless notified to the Licensing Authority and they are used in accordance with any guidance given by Lancashire Fire Service. Their use shall be indicated to any audience by means of easily seen and read notices, together with announcements prior to the commencement of the entertainment.
Lasers shall only be used on the premises in accordance with the requirements for the safe use of lasers as set down in the HSE Guide, The Radiation of Safety Lasers Used for Display Purposes [HS (G) 95] and BS 60825: Safety of Laser products British Standard 4803: part 3.
No strobe light shall be used in the premises unless a notice which can be clearly seen and easily read warning that strobe lights are in use in the premises is displayed at each entrance to the premises.
The premises shall be provided with adequate lavatory accommodation which shall, at all times, when the premises are in use be kept clean, ventilated, disinfected and supplied with hot and cold water, soap, toilet tissue, hand drying and sanitary towel disposal facilities as appropriate.
No nuisance shall be caused by noise coming from the premises or by vibration transmitted through the structure of the premises and where necessary, external doors and windows shall be kept closed when regulated entertainment is being provided, except in the event of an emergency.
Equipment, scenery etc relevant to any regulated entertainment or hire shall only be brought into and removed from the premises at a time when it is not likely to cause a disturbance to nearby residents.
Refuse, such as bottles shall be disposed of from the premises at a time when it is not likely to cause a disturbance to residents in the vicinity of the premises.
No light from or on the premises and any other light under the control of the premises shall be provided where that light causes a nuisance to any nearby premises.
Where a production of regulated entertainment contains material of an adult nature, the ticket sales shall be restricted to adults only, or with parental guidance, and the production company shall advertise the content and any restrictions in their publicity material.
Cigarette vending machines and gambling machines shall not be installed in the premises.
Children under the age of 18, shall not be permitted to attend charity functions involving gambling for fun.
Annex 3 - Conditions attached after a hearing by the Licensing Authority
Intoxicants shall only be sold to persons attending organised functions.
All staff shall receive suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this shall be made available to an authorised Officer upon request.
Appropriate measures shall be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
