Annex 1- Mandatory Conditions
No supply of alcohol may be made under this licence
a. At a time when there is no designated premises supervisor in respect of it or,
b. At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended
Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence.
1.-(1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
2. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
3. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
With effect from the 1st October 2010:
4.-(1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
5. The responsible person shall ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures
A responsible person is defined in S153(4) of the Licensing Act 2003 as:
(a) in relation to licensed premises-
(i) the holder of a premises licence in respect of the premises,
(ii) the designated premises supervisor (if any) under such a licence, or
(iii) any individual aged 18 or over who is authorised for the purposes of this section by such a holder or supervisor,
(b) in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables him to prevent the supply in question.
Annex 2 - Conditions Consistent with the Operating Schedule
In the case of those restaurant areas of the ground and first floors edged red on the plan there shall be:
(1) Suitable non-alcoholic beverages, including drinking water, shall be equally available for consumption with or otherwise as an ancillary to meals served in the licensed premises.
(2) The premises must be bona fide used for the purpose of habitually providing the customary main meal at midday or in the evening, or both, for the accommodation of persons frequenting the premises.
No person under the age of fourteen shall be in the bar of the licensed premises during the permitted hours unless attending for the purpose of taking a table meal in the restaurant area and accompanied by an adult over the age of 18. In this condition, “bar” means the area edge blue on the plan.
Any individual employed on the premises to carry out a security activity must be licensed by the Security Industry Authority.
An adequate number of licensed door supervisors shall be on duty as appropriate to any risk assessment and in accordance with the guidance under the Nightsafe Scheme. Such risk assessments shall be documented and kept on the premises and provided to the enforcement authorities on request.
Risk assessments carried put by or on behalf of the licence holder whish relate to a licensing objective shall be available for inspection by the enforcement authorities.
A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every exit.
A clear, legible and conspicuous notice requesting patrons not to smoke outside the premises and the frontage of the premises on Henry St and to avoid causing nuisance to local residents shall be displayed at every exit.
The Premises Licence Holder shall ensure that cooking, noxious or persistent smells generated at the premises do not cause nuisance to properties within close proximity.
The collection and disposal of waste/refuse shall not take place externally between the hours of 2200 and 0900 hours.
Meals and substantial refreshment shall be available at all times that the premises are open to the public.
Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
The licence holder and the DPS are to support and rigorously enforce the Challenge 21 Proof of Age policy. Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 21.
A refusals book shall be kept and maintained in the bar area.
All staff are to have received proof of age training and evidence of such training is to be maintained and be made available to the enforcement authorities on demand.
At any time the premises are open there shall be at least one person on duty and present at the reception area at the main entrance area to the premises.
At any time that regulated entertainment is taking place on the premises, all internal lobbied doors and external windows will be kept close except for the purposes of entering and leaving the premises or in the case of an emergency.
Noise from any regulated entertainment shall not exceed the background noise levels at the nearest sensitive premises.
Clear and conspicuous notices shall be displayed in the bar area of the premises indicating that it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.
The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to members of the public.
There shall be no drinks promotions that allow unlimited supply of alcohol for a set price.
The premises shall be operated in participation with the Pubwatch scheme.
Security arrangements shall be sufficient to discourage the sale and consumption of drugs and shall such arrangements include regular checks of toilet areas.
Records of incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection.
Confiscated and found drugs shall be stored, disposed of and transferred in accordance with procedures agreed with the Lancashire Constabulary.
The capacity of the ground floor bar is 140.
Save for the main entrance to the premises, all windows and doors of the premises facing into Henry St shall be closed at 2200 hours.
Subject to the terms of any Temporary Event Notice, entertainment in the ground floor bar shall be limited to piano music and singing accompanied by piano.
Seating and tables in the ground floor bar shall be set out in such a way as to avoid the area becoming a high volume vertical drinking establishment.
Save for emergency or in circumstances due to which the main, joint entrance to the premises is not usable, the central doule door into the ground floor bar from Henry Street shall not be used as an entrance or exit.
Annex 3 - Conditions Attached following a hearing by the Licensing Authority.
The premises shall be equipped with a closed circuit television system which is appropriate to its purpose, provided and maintained to the satisfaction of the enforcement authorities. Footage shall be retained for a minimum of 28 days if digital and 31 days if video recorded.
At least one Personal Licence holder will be at the premises while the supply of alcohol is being undertaken. The identity of the respective Personal Licence holder will be known to all other staff engaged in the supply of alcohol.
A drugs prevention strategy for the venue shall be developed and applied. This strategy shall include arrangements for the location of posters and the distribution of other information relating to drug risks, the dangers associated with drugs and the legal provisions relating to drug use.
There shall be seating in the ground floor bar for 50% of the total capacity of that part of the premises.
No admittance to new patrons after midnight on any day.
Alcohol in the restaurant area is only to be served by waiter/ess service to customers seated at tables and as an ancillary to a meal.
The double front doors to Henry Street shall be closed no later than 2000 each day.
