ANNEX 1 - MANDATORY CONDITIONS
The restrictions on the times during which the licence authorises the sale by retail of alcohol on the premises, set out in part M of the Licensable Activities section of this licence do not prohibit:
(a) during the first twenty minutes after the above hours, the taking of
the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
(b) consumption of the alcohol on the premises or the taking of sale or supply of alcohol to
any person residing in the licensed premises;
(c) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of
the alcohol so ordered;
(d) the sale of alcohol to a trader or club for the purposes of the trade or club;
(e) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or
supply of alcohol is carried out under the authority of the Secretary of State or an
authorised mess of members of Her Majesty’s naval, military or air forces;
(f) the taking of alcohol from the premises by a person residing there; or
(g) the supply of alcohol for consumption on the premises to any private friends of a person
residing there who are bona fide entertained by him at his own expense, or the
consumption of alcohol by persons so supplied; or
(h) the supply of alcohol for consumption on the premises to persons employed there for the
purposes of the business carried on by the holder of the licence, or the consumption of
liquor so supplied, if the liquor is supplied at the expense of their employer or of the
person carrying on or in charge of the business on the premises.
No supply of alcohol may be made under the premises licence:-
(a) at a time when there is no designated premises supervisor in respect of the premises
licence,
or
(b) at a time when the designated premises supervisor does not hold a personal licence or
his personal licence is suspended.
Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
No person under fourteen shall be in the bar of the licensed premises during the permitted hours unless one of the following applies:
(a) He is the child of the holder of the premises licence.
(b) He resides in the premises, but is not employed there.
(c) He is in the bar solely for the purpose of passing to or from some part of the premises
which is not a bar and to or from which there is no other convenient means of access
or egress.
(d) The bar is in railway refreshment rooms or other premises constructed, fitted and
intended to be used bona fide for any purpose to which the holding of the licence
is ancillary.
In this condition “bar” includes any place exclusively or mainly used for the supply and consumption of alcohol. But an area is not a bar when it is usual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals.
The admission of children under the age of 18 to film or video exhibitions permitted under the terms of this licence shall be restricted in accordance with any recommendations made by
(a) The British Board of Film Classification (BBFC) where the film has been classified by that Board, or
(b) The Licensing Authority where no classification certificate has been granted by the BBFC or where the licensing authority has notified the licence holder that section 20 (3) (b) of the Licensing Act 2003 applies to the film
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The style and operation of the premises shall not differ significantly from that of a residential hotel.
A personal licence holder shall be present on the premises at all times.
Staff shall be given appropriate training in respect of licensing and catering issues to the standards required by relevant legislation.
Digital CCTV cameras shall be installed both internally and externally.
Regular checks in and around the premises shall be conducted to monitor noise and disorderly behaviour.
A zero tolerance policy towards illegal drugs will be enforced at all times within the premises.
There shall be in place for the premises a policy to prevent the sale or supply of alcohol to persons under 18 years of age which requires any person who appears to be under the age of 18 years to produce a recognised documentation indicating that they are over 18 years of age.
A free phone taxi service shall be available to assist with customers’ onward journeys.
An appropriate Health and Safety policy shall be in place for the premises which shall include regular tests of the fire alarms, fire doors and emergency lighting system.
Regular fire drills shall be conducted with staff and all responsible staff made aware of designated muster points in the event of a fire.
Notices concerning the action to be taken in the event of a fire shall be on display in the premises and all fire exits shall be signposted.
A disabled ramp shall be provided to the front of the premises so that disabled persons may access and leave the premises.
The lift installed in the premises shall be periodically checked and maintained.
All disabled persons shall be made aware of the evacuation arrangements.
Any outbreak of fire of any kind shall be reported to the fire service immediately.
All fire fighting equipment shall be periodically assessed and maintained.
All fire instruction signs shall be illuminated so that they may be easily read at all times when residents and guests are on the premises.
An emergency lighting system shall be provided which shall be activated once the electricity supply to the regular lighting is interrupted. Such emergency lighting shall be periodically tested and inspected.
Suitable first aid facilities for both staff and customers shall be maintained at the premises.
Guest artists or bands performing at the premises shall not use special effects.
No nuisance shall be caused by noise coming from the premises or by a vibration transmitted through the structure of the premises.
Suitable means of air conditioning shall be provided to the premises.
Whenever regulated entertainment is taking place, windows and doors, save for entrance and exit purposes, shall be kept shut.
The grounds to the premises shall be maintained in a tidy condition and free from litter.
No form of adult entertainment shall be promoted at the premises.
During evenings, children shall be accompanied by an adult in the bar and restaurant areas.
Staff shall monitor the behaviour of children in areas where alcohol is being sold and should the children be considered to be running freely, the accompanying adult shall be asked to keep the children seated.
The premises shall be provided with a crèche, which shall be to the satisfaction of OFSTEAD and provide child focused events and entertainment programmes.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
The premises shall be operated in accordance with the principles outlined by the “Nightsafe” initiative, as are relevant to the premises, and indicated in the associated leaflet.
All staff shall receive suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
Only toughened glass vessels shall be used to dispense beverages to customers.
Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs
Risk assessments carried out by or on behalf of the Licence holder, which relate to a licensing objective shall be available for inspection by an officer or a Responsible Authority
The premises shall maintain a drinks pricing policy which complies with any Local Authority resolution made in accordance with approval from the Licensees Forum or any successor liaison body recognised by the Licensing Authority.
During the final hour of daily trading appropriate announcements shall be made or images projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents and to advise patrons of any taxi free-phone or collection arrangements available upon the premises.
The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
Frequent collection of glasses and bottles shall be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every exit.
