Annex 1 - Mandatory Conditions
No supply of alcohol may be made under this licence
a. at a time when there is no designated premises supervisor in respect of it or,
b. at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended
Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence.
Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours means:
) On weekdays, other than Christmas Day, Good Friday or New Year’s Eve, 10.00 hours to 23.00 hours
) On Sundays, other than Christmas Day or New Year’s Eve, 12.00 hours (noon) to 22.30 hours
) On Good Friday, 12.00 hours (noon) to 22.30 hours
) On Christmas Day, 12.00 hours (noon) to 15.00 hours and 19.00 hours to 22.30 hours
) On New Year’s Eve, except on a Sunday, 11.00 hours to 23.00 hours
) On New Year’s Eve on a Sunday, 12.00 hours (noon) to 22.30 hours
) On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, 00.00 hours (midnight) on 31st December).
The above restrictions do not prohibit:
) during the first twenty minutes after the above hours the consumption of the alcohol on the premises;
) during the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
) during the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;
) consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
) the sale of alcohol to a trader or club for the purposes of the trade or club;
) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
) the taking of alcohol from the premises by a person residing there; or
) the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
) the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
No person under fourteen shall be in the bar of the licensed premises during the permitted hours unless one of the following applies:
a) He is the child of the holder of the premises licence.
b) He resides in the premises, but is not employed there.
c) He is in the bar solely for the purpose of passing to or from some part of the premises that is not a bar and to or from some part of the premises where there is no other convenient means of access or egress.
d) The bar is in railway refreshment rooms or other premises constructed, fitted and intended to be used bona fide for any purpose to which holding of the licence is ancillary.
In this condition “bar” includes any place exclusively or mainly used for the supply and consumption of intoxicating liquor. However, an area is not a bar when it is usual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals.
There shall be no off sales, except within the area by the boundary wall as outlined in red on the attached plan
Intoxicating liquor shall only be supplied to person who:
) have paid for admission to the premises and entered before 8pm and are using the facilities of the complex.
) have been admitted to the premises free of charge before 8pm, but as a result of other members of their party having paid admission.
) entered the premises at or after 8pm and who have paid either an admission entrance fee of £5.00 or have entered by reason of a ticket purchased in advance and are using the facilities of the complex.
) Are attending a bona fide function on the premises where admission is only obtained by ticket or invitation.
Entrance or exit from the premises after 8pm shall be via the north side doorway marked red on the attached plan.
There shall be no admission of any kind to the premises after 10pm.
The admission of children under the age of 18 to film exhibitions permitted under the terms of this licence shall be restricted in accordance with any recommendations made by
() the British Board of Film Classification (BBFC) where the film has been classified by that Board, or
() the Licensing Authority where no classification certificate has been granted by the BBFC or where the licensing authority has notified the licence holder that section 20 (3) (b) of the Licensing Act 2003 applies to the film.
The terms, conditions and restrictions detailed in the Fylde Borough Council Places of Public Entertainment, Conditions of Licence (Second Schedule) and attached to this licence must be adhered to all times that regulated entertainment takes place at the premises.
The maximum number of persons permitted in the:
Reception Area shall be restricted to 180
Cinema 1 shall be restricted to 160
Cinema 2 shall be restricted to 66
Cinema 3 shall be restricted to 114
Cinema 4 shall be restricted to 82
The numbers referred to above include disabled spaces
The Licensee shall comply with such provisions of the Cinematograph (Safety) Regulations 1955 as restrict the use of the premises.
Where the number of people attending the entertainment exceeds 100 the licensee shall ensure that the provisions of Section 12 of the Children and Young Persons act 1933 are complied with.
