Annex 1 - Mandatory Conditions
No supply of alcohol may be made under this licence
a. At a time when there is no designated premises supervisor in respect of it or,
b. At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended
Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence.
The admission of children under the age of 18 to film or video exhibitions permitted under the terms of this licence shall be restricted in accordance with any recommendations made by
(a) The British Board of Film Classification (BBFC) where the film has been classified by that Board, or
() The Licensing Authority where no classification certificate has been granted by the BBFC or where the licensing authority has notified the licence holder that section 20 (3) (b) of the Licensing Act 2003 applies to the film
Annex 2 - Conditions consistent with the Operating Schedule
The style and operation of the premises shall not differ significantly from that of a
residential hotel.
Staff shall be given appropriate training in respect of licensing issues and fire procedures to the standards required by relevant legislation.
The premises shall partake in the South Fylde Watch Cascade Alert scheme.
The premises shall be equipped with a closed circuit television system, which is appropriate to its purpose.
A suitable level of Illumination shall be provided to the car park until 1am.
A zero tolerance policy towards illegal drugs will be enforced at all times within the premises.
There shall be in place for the premises a policy to prevent the sale or supply of alcohol to persons under 18 years of age which requires any person who appears to be under the age of 21 years to produce a recognised documentation indicating that they are over 18 years of age.
Appropriate signs shall be displayed in the bar area stating the 18 years policy.
A free phone taxi service shall be available to allow non-residents to leave the premises promptly and quietly.
All emergency lighting, fire alarms, fire fighting equipment and electrical portable appliances at the premises shall be inspected and tested annually.
Notices as to the action to be taken in the event of a fire shall be displayed at the premises.
All fire exits shall be clearly signposted.
A disabled ramp shall be provided to the main entrance of the main premises enabling disabled persons to access and leave the premises.
All disabled persons on the premises shall be made aware of the evacuation procedure.
Any outbreak of fire of any kind shall be reported to the Fire Service immediately.
All fire instruction signs shall be illuminated so that they may easily read at all times when residents and guests are present on the premises.
Emergency lighting shall be provided which shall be activated once the electricity supply to the regular lighting is interrupted.
There shall be regular inspection of all normal and emergency lighting.
There shall be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials.
Heads of departments and duty managers shall be trained in first aid.
The swimming pool at the premises shall be accessed by a code and children under 15 shall be supervised by an adult.
Life saving equipment shall be maintained at the swimming pool and those persons that supervise the pool area shall be trained resuscitation.
No nuisance shall be caused by noise coming from the premises or by vibration transmitted through the structure of the premises.
Suitable means of air conditioning shall be provided to the premises.
When amplified musical entertainment is taking place inside the premises, windows and doors, save for entrance and exit purposes, shall be kept shut.
Noise from regulated entertainment in the Ballroom shall be kept to a reasonable level.
The grounds of the premises shall be kept tidy and free from, nuisance to neighbouring properties and residents.
Whenever entertainment is being offered within the premises, patrols shall be undertaken by members of staff to check on any noise pollution or disorderly behaviour.
No form of adult entertainment shall be promoted by the premises.
An children’s play area shall be provided for the premises and children shall be required to be supervised by the accompanying adult at all times.
Criminal Record Bureau checks shall be carried out on staff involved in looking after, supervising and entertaining children.
Annex 3 - Conditions attached after a hearing by the Licensing Authority
The premises shall be operated in accordance with the principles outlined by the ‘Nightsafe’ Scheme, as are relevant to those premises, and indicated in the associated leaflet.
All staff shall receive suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
Appropriate measures shall be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
The premises are to be equipped with a closed circuit television system, which is appropriate to its purpose and provided and maintained to the satisfaction of the enforcement Authorities.
Only toughened glass vessels are used to dispense beverages to customers.
At least one personal licence holder will be available while the supply or sale of alcohol is being undertaken (who’s identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs
Risk assessments carried out by or on behalf of the Licence holder, which relate to a licensing objective shall be available for inspection by an officer or a Responsible Authority
The premises shall maintain drinks pricing policy which complies with any Local Authority resolution made in accordance with approval from the Licensees Forum or any successor liaison body recognised by the Licensing Authority.
Security arrangements shall be sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas
Records of incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection
Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary
During the final hour of daily trading appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents and to advise patrons of any taxi free-phone or collection arrangements available upon the premises.
The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every exit.
