Annex 1 - Mandatory Conditions
No supply of alcohol may be made under this licence
a. At a time when there is no designated premises supervisor in respect of it or,
b. At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended
Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence.
The admission of children under the age of 18 to film or video exhibitions permitted under the terms of this licence shall be restricted in accordance with any recommendations made by
(a) The British Board of Film Classification (BBFC) where the film has been classified by that Board, or
() The Licensing Authority where no classification certificate has been granted by the BBFC or where the licensing authority has notified the licence holder that section 20 (3) (b) of the Licensing Act 2003 applies to the film
The terms, conditions and restrictions detailed in the Fylde Borough Council Places of Public Entertainment, conditions of Licence (Second Schedule) and attached to this licence must be adhered to all times that regulated entertainment takes place at the premises.
The maximum number of persons permitted in the Normandie Room shall be restricted to 250.
Noise levels from entertainment’s shall not exceed 33dB LA eq: (5 minutes) when measured at a point on a boundary at any residential property.
The restrictions on the times during which the licence authorises the sale by retail of alcohol on the premises, set out in part M of the Licensable Activities section of this licence do not prohibit:
() during the first twenty minutes after the above hours the consumption of the alcohol on the premises;
() during the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
() during the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;
() consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the premises.
Suitable non-alcoholic beverages, including drinking water, shall be equally available for consumption with or otherwise as an ancillary to meals served in the licensed premises.
The premises must be bona fide used for the purpose of habitually providing for reward board and lodging including breakfast and one other at least of the customary main meals.
Intoxicating liquor shall not be sold or supplied otherwise than to:
1 Persons taking table meals there for consumption be such persons as an ancillary to their meals.
or
2 Persons residing there or their private friends bona fide entertained by them at their own expense and for consumption by such persons or their private friends so entertained by them either on the premises or with a meal supplied at but to be consumed off the premises.
or
3 Persons attending bona fide pre-arranged functions held on the premises organised other than by or on behalf of the licensee or his representative, where admission to the function is obtained by ticket or an invitation or obtained otherwise than at the door of the premises at the time of the function.
or
4 Persons who are partaking in the sporting facilities provided on the premises namely, the Hotel’s swimming pool and squash court and Health Centre
There shall be afford in the premise for persons provided with board and lodgings for reward adequate sitting accommodation in a room not used or to be used for sleeping accommodation, for the service of substantial refreshment or for the supply or consumption of intoxicating liquor.
Annex 2 - Conditions consistent with the Operating Schedule
The style and operation of the premises shall not differ significantly from that of a
residential hotel.
There shall a security presence at night to prevent any disorder.
Staff shall be given appropriate training in respect of licensing issues.
A zero tolerance policy towards illegal drugs and excessive consumption of alcohol shall be enforced at all times within the premises.
A suitable level of Illumination shall be provided to the interior and exterior of the premises.
Consumption of alcohol in areas other than bars and bedrooms shall be prohibited.
Appropriate fire fighting equipment and fire precautions shall be maintained at the premises.
Adequate first aid provision is available at all times the premises are being operated.
The fabric of the building should be such as to retain sound as appropriate.
Staff shall ensure that any noise emanating from the premises is kept to minimum to avoid causing disturbance to guests and members of the public.
No persons under the age of 18 years shall be served alcohol.
Children shall be required to be supervised by the accompanying adult at all times.
Anyone who appears to be under the age of 18 and who is attempting to buy alcohol must be required to produce proof of age before such a sale is made.
Access to gaming machines shall be restricted as appropriate.
Annex 3 - Conditions attached after a hearing by the Licensing Authority
The premises shall be operated in accordance with the principles outlined by the ‘Nightsafe’ Scheme, as are relevant to those premises, and indicated in the associated leaflet.
All staff shall receive suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
Appropriate measures shall be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
The premises are to be equipped with a closed circuit television system, which is appropriate to its purpose and provided and maintained to the satisfaction of the enforcement Authorities.
Only toughened glass vessels are used to dispense beverages to customers.
At least one personal licence holder will be available while the supply or sale of alcohol is being undertaken (who’s identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs
Risk assessments carried out by or on behalf of the Licence holder, which relate to a licensing objective shall be available for inspection by an officer or a Responsible Authority
The premises shall maintain drinks pricing policy which complies with any Local Authority resolution made in accordance with approval from the Licensees Forum or any successor liaison body recognised by the Licensing Authority.
Security arrangements shall be sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas
Records of incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection
Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary
During the final hour of daily trading appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents and to advise patrons of any taxi free-phone or collection arrangements available upon the premises.
The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every exit.
