ANNEX 1 - MANDATORY CONDITIONS
No supply of alcohol may be made under this licence
a. at a time when there is no designated premises supervisor in respect of it or,
b. at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended
Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The Designated Premises Supervisor, when present and all members of staff shall ensure that all lawful instructions and /or directions given by the Police are complied with.
At least one personal licence holder shall be available and/or contactable by telephone while the supply or sale of alcohol is being undertaken (whose identity shall be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
There shall be no drinks promotions that allow unlimited supply of alcohol for a set price.
The primary activity of the premises shall be a restaurant/café and the provision of food, including full meals and snacks shall form a substantial element of the operation of the premises and be available up to 1 hour before the terminal hour
Hot drinks, soft drinks and non-alcoholic drinks shall be available, as an alternative to alcohol, at all times.
Adequate provisions shall be made to prevent unauthorised access to the storage of empty bottles.
Appropriate measures shall be taken to ensure that staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises and outdoor seating area.
Frequent collection of glasses and bottles shall be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
Whenever the premises are open after midnight, patrons shall be reminded of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents.
The business shall be operated in accordance with existing safety legislation.
Adequate and appropriate fire fighting equipment shall be available on the premises.
Adequate and appropriate first aid equipment and materials shall be available on the premises.
The premises shall be provided with adequate lavatory accommodation which shall at all times when the premises are in use be kept clean, ventilated, disinfected and supplied with hot and cold water, soap, toilet tissue, hand drying and sanitary towel disposal facilities as appropriate.
A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to caravaners and local residents when leaving the premises late at night shall be displayed on the premises.
The primary means of entertainment at the premises shall be by means of recorded music which shall generally be maintained at a low level.
No nuisance shall be caused by noise coming from the premises or vibration transmitted through the structure of the premises.
The volume of any amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
All ventilation and extract systems shall be designed and maintained so as to prevent noxious smells causing a nuisance in the area.
The immediate vicinity of the premises shall be regularly checked and any dropped litter or spilled food shall be collected and removed.
There shall be in place for the premises a policy to prevent the illegal sale or supply of alcohol to persons under 18 years of age. That policy shall require any person who appears to be under the age of 21 years to produce a recognised proof of age card accredited under the Proof of Age Standards Scheme (PASS) or if a proof of age card is not available a photo driving licence or passport indicating that they are over 18 years of age.
All staff shall receive appropriate training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this shall be made available to an authorised officer upon request.
Accompanied children under 16 may be permitted in the premises in line with the provisions of the Licensing Act 2003.
