ANNEX 1 - MANDATORY CONDITIONS
No supply of alcohol may be made under this licence
a. at a time when there is no designated premises supervisor in respect of it or,
b. at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended
Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Every supply of alcohol must be made or be authorised by a person who holds a personal licence.
At least one personal licence holder shall be on the premises at all times during which the supply or sale of alcohol is being undertaken (whose identity shall be known to all other staff engaged in the supply or sale of alcohol).
The premises are to be equipped with a closed circuit television system which meets the criteria detailed in Lancashire Constabulary's Guidance Document CCTV/AW1, and which is well maintained and fully functional during the hours the premises are open to members of the public. CCTV recordings shall be retained for a period of 30 days and made available within a reasonable time upon request by the enforcement authorities.
A staff member who is conversant with the operation of the CCTV system shall be on the premises at all times that the club is open to the public. This staff member shall be able to show police recent data or footage with the absolute minimum of delay when requested. This data or footage reproduction should be almost instantaneous.
The premises shall be operated in accordance with the principles outlined by the Nightsafe Scheme, as are relevant to those premises and indicated in the associated leaflet.
An adequate number of licensed door supervisors shall be on duty as appropriate to any risk assessment and in accordance with the guidance under the Nightsafe Scheme.
Local Pubwatch protocols shall be adhered to and entry refused to any persons currently under Pubwatch ban.
The premises shall maintain a drinks pricing policy which complies with any Local Authority resolution made in accordance with approval from the Licensees Forum or any successor liaison body recognised by the Licensing Authority.
Security arrangements shall be sufficient to discourage the sale and consumption of drugs and shall ensure regular checks of toilet areas.
Records of incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection.
Confiscated and found drugs shall be stored, disposed of and transferred in accordance with procedures agreed with the Lancashire Constabulary.
Frequent collection of glasses and bottles shall be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
Appropriate measures shall be taken to ensure that staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
No person in possession of a drink in a sealed or unsealed container shall be allowed to enter the premises except for the purposes of delivery
No drink shall be removed from the premises in an unsealed container.
Only Toughened glass vessels shall be used to dispense draught beers to customers.
The Designated Premises Supervisor, Duty Manager or other suitably Trained Person shall be a member of and regularly attend at the meetings of any Pub and Club watch scheme for the area within which the premises is located and shall register in and use Community Radio Network if available.
The following Dispersal Policy shall be operated.
The licence holder shall seek to ensure that Clients leave the Licensed premised in an orderly manner and shall apply the following measures:-
- Only background music shall be played over the final 30 minutes of trading
- The disc jockey(s) shall remind patrons of the need to leave the vicinity of the premises in an orderly manner.
- The disc jockey(s) shall remind patrons of the location of taxi services immediately outside the premises.
- The door staff shall, when appropriate, remind patrons in the vicinity of the premises of any need to moderate their behaviour.
Any patrons who disregard the advice of the door staff shall subsequently be denied entry to the premises until the Licence holder is satisfied that they shall conduct themselves in a satisfactory manner.
Adequate first aid provision and fire-fighting shall be available at all times on the premises
The licence holder and all managers shall be suitably trained in all aspects of the safe and efficient running of the venue.
The premises shall be provided with adequate lavatory accommodation which shall at all times when the premises are in use be kept clean, ventilated, disinfected and supplied with hot and cold water, soap, toilet tissue, hand drying and sanitary towel disposal facilities as appropriate.
The volume of amplified sound used in connection with entertainment shall at all times be under the control of the management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
A clear and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents when leaving the premises, shall be erected and maintained in a prominent position at the exit.
The departure of customers from the premises shall be effectively managed by doorstaff who shall request patrons to leave quietly and to avoid causing noise, nuisance or disturbance to local residents.
Customers who regularly leave the premises in a noisy manner, potentially causing noise, nuisance or disturbance to local residents shall be banned from the premises.
At all times when recorded or amplified music is being provided on the premises, such music shall be subject to an automatic noise limitation device (or other suitable device) the device being set to reduce the level of sound if the volume reaches a level pre-set to the reasonable satisfaction of the Environmental Health Authority.
Doors and windows shall be kept closed when recorded or amplified music is being played except in the event of an emergency.
Commercial waste produced at the premises, including but not limited to empty bottles, shall not be deposited in any outdoor waste receptacle between the hours of 11pm and 8 am.
No nuisance shall be caused by noise coming from the premises or vibration transmitted through the structure of the premises.
Regular assessments of the noise coming from the premises shall be conducted when the premises are used for regulated entertainment and steps shall be taken to reduce the level of noise where it is likely to cause a disturbance to local residents.
No deliveries, removal of bottles, refuse and other commercial vehicle movements onto the premises shall take place before 0730 hours and after 2000 hours.
There shall be no emission from the premises of any offensive smells, which are likely to cause a nuisance.
No light from or on the premises and other light under the control of the premises shall be provided where that light causes a nuisance to nearby premises.
There shall be placed at all exits from the premises, in a place where they can be seen and easily read by patrons, notices requiring customers to leave the premises and the area quietly.
The Challenge 21 Proof of Age policy shall be supported and rigorously enforced. Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
photo driving licence;
passport;
Proof of Age Standards Scheme Card.
All staff shall have received suitable training in relation to the proof of age scheme and records to evidence this shall be made available to an authorised officer upon request.
A notice or notices shall be displayed in and at the entrance to the premises where they can be clearly seen and read and shall indicate that it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
The maximum number of person allowed on the premises shall not exceed the capacity of 110 persons including staff.
When door supervisors are on duty, an effective method of controlling the number of persons in the premises shall be maintained at all times by the use of clicker devices or by such other equally effective means of control. Written confirmation of procedures / occupancy numbers shall be provided to door staff.
The ventaxia unit installed in a window to the front of the premises shall be acoustically insulated to prevent noise leakage
During performances of amplified entertainment acoustic curtains shall be placed over the windows to both the front and the rear of the premises to reduce the risk of disturbance to neighbouring dwellings.
