ANNEX 1 - MANDATORY CONDITIONS
No supply of alcohol may be made under this licence
a.
at a time when there is no designated premises supervisor in respect of it or,
b.
at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended
Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence.
The admission of children under the age of 18 to film exhibitions permitted under the terms of this licence shall be restricted in accordance with any recommendations made
by
() the British Board of Film Classification (BBFC) where the film has been classified by that Board, or
() the Licensing Authority where no classification certificate has been granted by the BBFC or where the licensing authority has notified the licence holder that section 20 (3) (b) of the Licensing Act 2003 applies to the film.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The Premises Licence Holder shall liaise and co-operate with the Responsible Authorities.
A proof of age policy shall operate in relation to licensable activities.
A zero tolerance towards illegal drugs shall operate at all times.
Any drinks promotions shall not adversely affect the promotion of responsible drinking.
Customers shall be encouraged to leave the premises in a quiet and orderly manner.
Staff shall be trained to observe the measures necessary to promote the licensing objectives.
The Premises Licence Holder shall operate in accordance with all relevant legislation which promotes the public safety objective including, but not limited to, the Health and Safety at Work etc Act 1974 and associate regulations, the Food Safety Act 1990, the Regulatory Reform (Fire Safety) Order 2005 and the Disability Discrimination Act 1995.
The necessary fire precautions shall be installed and maintained.
The Premises Licence Holder shall operate in accordance with all relevant legislation which promotes the public nuisance objective including, but not limited to the Environmental Protection Act 1990 and the Noise Act 1996.
The premises shall be adequately ventilated to prevent nuisance.
Arrangements shall be made for the storage and disposal of refuse which do not cause a nuisance.
Any noise from the licensable activities provided shall be monitored in order to prevent nuisance.
Non-alcoholic drinks shall be available.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
The terrace shall be closed to patrons no later than 23:00 hours.
All doors and windows shall be closed during the performances of regulated musical entertainment except for access and egress or as required by a Responsible Authority.
The Designated Premises Supervisor, when present and all members of staff shall ensure that all lawful instructions and/or directions given by the Police are complied with.
The premises shall be operated in accordance with the principles outlined by the Nightsafe Initiative, in so are as they are relevant to the premises.
Appropriate measures shall be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
Frequent collection of glasses and bottles shall be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
The premises shall be operated in participation with the Pubwatch scheme.
Risk assessments carried out by or on behalf of the Licence holder, which relate to a licensing objective shall be available for inspection by an officer of a Responsible Authority.
Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
Records of incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection.
Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
In 60% of the licensed area accessible to the public alcohol may only be supplied to customers taking a table meal.
The whole of the licensed area accessible to the public shall be laid out with tables and chairs.
Whenever licensable activities are available at the premises a waiter/waitress service shall be provided.
