ANNEX 1 - MANDATORY CONDITIONS
No supply of alcohol may be made under this licence
a. at a time when there is no designated premises supervisor in respect of it or,
b. at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended
Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The provision of food shall form a substantial element of the operation of the premises.
The Designated Premises Supervisor, when present, and all members of staff shall ensure that all lawful instructions and /or directions given by the Police are complied with.
Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
No member of staff shall sell alcohol unless they hold a current personal licence or have been authorised to do so by the DPS or other personal licence holder who is satisfied as to their competence to make such sales.
There shall be no drinks promotions that allow unlimited supply of alcohol for a set price.
Hot drinks, soft drinks and non-alcoholic drinks shall be available, as an alternative to alcohol, at all times.
Appropriate measures shall be taken to ensure staff prevent the removal of bottles or glasses from the curtilage of the licensed premises.
Frequent collection of glasses and bottles shall be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
Adequate first aid and fire-fighting provision and shall be available at all times
The departure of customers from the premises shall be effectively managed by staff who shall request patrons to leave quietly and to avoid causing noise, nuisance or disturbance to local residents.
There shall be no regulated entertainment on the patio area after 2230.
All windows and doors shall be closed after 2200 save for access and egress when regulated entertainment is taking place.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
The premises shall be operated as a quality café/restaurant with facility for community use and shall NOT be allowed to become a public house, nightclub, vertical drinking establishment or similar
The premises shall not be used for private functions catering primarily for persons under the age of 21 years.
Meals and substantial refreshment shall be available at all times the premises are open to the public.
Intoxicating liquor shall be sold or supplied only to persons who are seated at tables unless the premises are being used for a community function or other pre-arranged event.
The supply of intoxicating liquor on the premises shall be by waiter/waitress service only unless the premises are being used for a community function or other pre-arranged event.
Between 7pm and closing time on any evening, intoxicating liquor shall not be sold or supplied on the premises otherwise than to persons taking table meals there and for consumption by such a person as ancillary to the meal unless the premises are being used for a community function or other pre-arranged event.
Only polycarbonate or toughened glass vessels shall be used to dispense beers, lagers and ciders to customers.
At least one personal licence holder, whose identity shall be known to all other staff engaged in the supply or sale of alcohol, will be contactable while the supply or sale of alcohol is being undertaken, except in the case of emergency.
The licence holder and the DPS are to support and rigorously enforce the Challenge 21 Proof of Age policy. Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: photo driving licence; passport; Proof of Age Standards Scheme Card; any other locally or nationally approved form of identification which may be introduced in the future.
All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this shall be made available to an authorised officer upon request.
The premises are to be equipped with a closed circuit television system, which is appropriate to its purpose and provided and maintained to the satisfaction of the enforcement authorities.
There shall be no off sales.
Suitable beverages other than intoxicating liquor (including drinking water) shall available at all times the premises are in operation.
The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to members of the public.
Notices shall be displayed at the exits to the premises asking customers to leave the premises and area quietly and to have consideration for residents.
Staff arriving before 0900 hours or departing late at night when the business has ceased trading shall conduct themselves in such a manner to avoid disturbance to nearby residents.
Noise from any regulated entertainment, mechanical ventilation or refrigeration plant shall not cause unreasonable disturbance or nuisance to residents and business owners in the area.
The arrangement for the storage of empty bottles shall prevent unauthorised access to those bottles.
Suitable containers shall be provided for the storage of waste, which are constructed and maintained to prevent the removal of such waste by vandals, thieves, animals, accidental spillage or inclement weather.
