ANNEX 1 - MANDATORY CONDITIONS
No supply of alcohol may be made under this licence
a. at a time when there is no designated premises supervisor in respect of it or,
b. at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended
Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence.
The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
The responsible person shall ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures
A responsible person is defined in S153(4) of the Licensing Act 2003 as:
(a) in relation to licensed premises-
(i) the holder of a premises licence in respect of the premises,
(ii) the designated premises supervisor (if any) under such a licence, or
(iii) any individual aged 18 or over who is authorised for the purposes of this section by such a holder or supervisor,
(b) in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables him to prevent the supply in question.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
All staff shall be given training on the licensing objectives and the measures taken by the Premises Licence Holder to support their achievement.
All staff shall have a personal record of training and checklists shall be provided for key policies and procedures (Challenge 25, drunkenness on premises etc) with supervision during their initial employment period.
The Premises Licence Holder shall actively engage with local bodies in support of the licensing objectives.
A Personal Licence holder shall normally be present on the premises. If not, a record of authorisations shall be kept.
Additional locks shall be fitted to the front door and rear windows and an alarm system shall operate when the premises are closed.
Staff shall have access to a personal alarm system.
The Premises Licence Holder shall participate in the local “Shopwatch”, off licence forum and support the Fylde Local Strategic Partnership.
The Premises Licence Holder shall ensure the responsible promotion of alcoholic drinks with the Best Practice Guidelines from the Portman Group Code of Practice.
The premises shall sell food and promote sensible consumption practices and clearly label lower alcohol and alcohol free products.
Music shall not be played at the premises.
A “Challenge 25” scheme shall be operated, supported by displays of explanatory material including reminders to adults that is an offence to buy alcohol on behalf of persons aged under 18.
A challenge/refusals log shall be maintained backed up by receipt marking.
All staff shall have proof of age training and permanent staff shall be encouraged to undertake formal training leading to Personal Licence holder status.
The premises website (The Polish Vodka Company) shall concentrate on the sale of premium spirits, principally Polish vodkas with a minimum order value plus postage and packing, aimed at discerning drinkers.
The website home page shall clearly state internet sales shall only be made to persons aged 18 or over.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
The licence holder and the DPS are to support and rigorously enforce the Challenge 21 Proof of Age policy. Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: photo driving licence; passport; Proof of Age Standards Scheme Card; any other locally or nationally approved form of identification which may be introduced in the future.
The premises shall to be equipped with a closed circuit television system, which is appropriate to its purpose and provided and maintained to the satisfaction of the enforcement authorities.
No alco-pops are to be made available on the website.
All internet sales shall be paid for via credit or debit cards which are only available to adults, or any other payment methods introduced in the future which are only available to adults.
Secure records of internet sales shall be kept for one calendar month after each purchase including the delivery address and the name of the purchaser. These records shall be provided to Police on request.
Deliveries shall require an adult’s signature on receipt of goods. The responsible person shall only choose postage options which require a signature on receipt of goods.
The responsible person shall only utilise national and/or international companies for the delivery of internet purchases. These include the Post Office, Royal Mail, DHL and similar courier businesses.
The earliest delivery option made available to internet customers shall be next day delivery. Private couriers are not to be used in order to provide a same day delivery service.
The website shall detail relevant offences under the Licensing Act 2003 regarding the supply of alcohol to persons under the age of 18. Customers must read this information and confirm they are 18 or over on a suitable page on the website before the transaction is complete. Customers shall not be able to bypass this section of the purchasing process.
Customers shall be informed prior to the purchase of alcohol that if the company suspects alcohol is being procured by or on behalf of a person under 18 years of age, this information will be provided to the Police and the sale refused.
The website shall provide links to national responsible drinking websites and will promote up to date Government guidelines on safe alcohol consumption levels.
Inside the premises, the CCTV system in existence shall cover, as a minimum, the area which shall be used for alcohol. Images shall be retained for a period of 28 days and made available on enforcement request.
