ANNEX 1 - MANDATORY CONDITIONS
No supply of alcohol may be made under this licence
a. at a time when there is no designated premises supervisor in respect of it or,
b. at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended
Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence.
The admission of children under the age of 18 to film exhibitions permitted under the terms of this licence shall be restricted in accordance with any recommendations made
by
() the British Board of Film Classification (BBFC) where the film has been classified by that Board, or
() the Licensing Authority where no classification certificate has been granted by the BBFC or where the licensing authority has notified the licence holder that section 20 (3) (b) of the Licensing Act 2003 applies to the film.
The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
A responsible person is defined in S153(4) of the Licensing Act 2003 as:
(a) in relation to licensed premises-
(i) the holder of a premises licence in respect of the premises,
(ii) the designated premises supervisor (if any) under such a licence, or
(iii) any individual aged 18 or over who is authorised for the purposes of this section by such a holder or supervisor,
(b) in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables him to prevent the supply in question, and
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The sale and supply of alcohol shall be ancillary to the provision of the table meals or persons purchasing food for consumption on the premises.
The premises shall be operated in accordance with the principles outlined by the Nightsafe Initiative as are relevant to those premises and indicated in the associated leaflet.
All staff shall receive suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this shall be made available to an authorised officer upon request.
Another member of staff shall be nominated to act for the Designated Premises Supervisor in their absence, whose identity shall be known by all other staff when such absence occurs.
Hot drinks, soft drinks and non-alcoholic drinks shall be available as an alternative to alcohol at all times.
The provision of food, including full meals and snacks shall form a substantial element of the operation of the premises.
Whenever the premises are open after midnight patrons shall be reminded to leave the premises without annoyance or disturbance to local residents.
The premises shall benefit from a Health and Safety Policy, Public Liability Insurance, fire alarm, emergency lighting, fire extinguishers and safety and warning signs.
Suitable and sufficient disabled facilities and access shall be provided.
Glasses and bottles shall be removed on a regular basis.
Adequate first aid provision shall be available at all times.
All staff shall be made aware of safety matters in relation to children.
At all times when recorded music or amplified music is being provided on the premises, such music shall be subject to an automatic noise limitation device (or other suitable device), the device being set to reduce the level of sound if the volume reaches a pre-set level. Such level shall be to the reasonable satisfaction of the Environmental Health Authority.
During the performance of all amplified regulated entertainment after 2200 hours all doors and windows shall remain closed except for access and egress.
Risk assessments carried out by or on behalf of the licence holder which relate to a licensing objective shall be available for inspection by an officer of a Responsible Authority.
A staff member who is conversant with the operation of the CCTV system shall be on the premises at all times the restaurant is open to the public. This staff member shall be able to show police recent data or footage with the absolute minimum of delay when requested. This data or footage reproduction should be almost instantaneous.
Off sales from the premises shall be in sealed containers only. Any unfinished bottles of wine must be re-corked being taken away from the premises.
Regular checks shall be conducted of the fire exits to ensure they are clear and unblocked. Staff shall be properly trained in fire procedures.
An occupancy level shall be determined for the premises and entry restricted at busy times to provide overcrowding.
Staff shall be employed to ensure any noisy queues are kept to a minimum in residential areas.
The area around the premises shall be regularly cleaned.
Commercial refuse shall be cleared regularly and at times that will not disturb local residents.
Lights from the premises shall not be directed towards residential properties.
There shall be entertainment of an adult nature at the premises.
Access to any gaming machines shall be restricted.
Any children shall be accompanied by a responsible adult.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
CCTV will be installed internally and externally at the premises and will comply with the following:-
The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises, with the exception of the toilets, are to be covered by the system;
The system will display on any recording the correct time and date of the recording;
The system will make recordings during all hours the premises is open to the public;
VCR tapes or digital recording shall be held for a minimum of 30 days after the recording is made and will be made available to the Police for inspection upon request;
The system will as a minimum, record images of the head and shoulders of all persons entering the premises.
A zero tolerance policy towards illegal drugs will be enforced at all times within the premises.
A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every exit.
The licence holder and/or DPS are to support and rigorously enforce the Challenge 21 Proof of Age policy. Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: photo driving licence; passport; Proof of Age Standards Scheme Card; or any other locally or nationally approved form of identification which may be introduced in the future. If no suitable identification is provided, sale of alcohol must be refused.
