ANNEX 1 - MANDATORY CONDITIONS
No supply of alcohol may be made under this licence
a. at a time when there is no designated premises supervisor in respect of it or,
b. at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended
Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence.
The admission of children under the age of 18 to film exhibitions permitted under the terms of this licence shall be restricted in accordance with any recommendations made
by
() the British Board of Film Classification (BBFC) where the film has been classified by that Board, or
() the Licensing Authority where no classification certificate has been granted by the BBFC or where the licensing authority has notified the licence holder that section 20 (3) (b) of the Licensing Act 2003 applies to the film.
1. (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
2. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
3. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
With effect from the 1st October 2010:
4.-(1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
5. The responsible person shall ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures
A responsible person is defined in S153(4) of the Licensing Act 2003 as:
(a) in relation to licensed premises-
(i) the holder of a premises licence in respect of the premises,
(ii) the designated premises supervisor (if any) under such a licence, or
(iii) any individual aged 18 or over who is authorised for the purposes of this section by such a holder or supervisor,
(b) in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables him to prevent the supply in question.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
A personal licence holder shall be on site at all times.
Staff trained in licence regulations shall be present.
During the event, the rules and policies shall be displayed and given to all ticket purchasers.
Staggered finishing times for the entertainment, bars and catering units shall be applied to facilitate the dispersal of festival goers.
A zero tolerance policy towards any illegal and immoral activity and misuse of alcohol shall be applied.
Security staff, stewards and operational staff shall have means of electronic communication such as two way radios.
No glasses or bottles shall be permitted on site.
An adequate number of security and stewards shall be provided at the premises.
An adequate number of suitable emergency exits shall be provided at the premises.
Sufficient fire fighting equipment shall be provided in relation to the occupancy.
Suitable first aid provision, including St Johns Ambulance, private medical providers and an ambulance shall be at the site at all times.
Signage detailing health and safety rules shall be displayed on site.
There shall be a dedicated emergency vehicles access point provided.
There shall be a fire assembly point and alternative and disabled parking.
Disabled toilets shall be provided.
Exit signs shall be posted around the site and on the site map.
Electrical, fire and generator certificates shall be provided.
The licence shall only have effect for three days in a calendar year.
The stages and amplified sound shall make the best advantage of wind breaks to minimise the travel of sound. All amplified sound shall be monitored in conjunction with noise pollution requirements.
Children shall be under the care of adult supervision.
Any areas of ground unsuitable or dangerous to children shall be cordoned off.
Entertainment shall be monitored to ensure children come to no harm,
Family viewing and dancing areas shall be provided at stage areas.
All performers shall be warned be about foul language and abusive gestures - any act deemed to jeopardise the family atmosphere shall be terminated.
Childrens entertainment areas shall be provided and CRB checks of entertainers shall be required.
Stewards shall be on duty during all children’s specific entertainment.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
1. A mobile CCTV will be in operation at the premises at all times whilst open to the public. The CCTV system shall be maintained and operated to the reasonable satisfaction of Lancashire Constabulary. Adequate CCTV will be in operation at the entry and exit to the premises and in all bar areas accessible to the public.
2. The system shall, as minimum, record images of the head and shoulders of all persons entering the premises. The system will make recordings during all hours the premises are open to the public.
3. A staff member who is conversant with the operation of the CCTV system will be on the premises at all times that the premises are open to the public. This staff member will be able to show police recent data or footage with the absolute minimum of delay when requested. This data or footage reproduction should be almost instantaneous.
4. VCR or digital recordings shall be held for a minimum of 28 days after the recording is made and will be available to the Police for inspection upon request.
5. The Police Licensing Unit shall be notified on any occasion when the CCTV or radio system is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
6. Entry to the Premises will only be admitted on production of a valid ticket.
7. An adequate number of licensed door supervisors and stewards will be on duty as appropriate to any risk assessment, and will not fall below that listed in the Event Stewarding Plan (as documented by Chris Callaghan on 07/08/10).
8. Each individual at the premises in order to carry out security activity must be licensed by the Security Industry Authority (SIA).
9. There will be radio communication between all key personnel on site.
10. All SIA personnel, stewards and organisers will wear high visibility vests/ jackets.
11. SIA registered door supervisors will monitor and search all members of the public entering and (where appropriate) exiting the premises.
12. SIA personnel and volunteers will be pre briefed on procedures if drug taking is suspected and bag checks will be in operation on entry to the premises.
13. Where there is reasonable suspicion that drugs are being carried, the Licence Holder and DPS shall ensure that the outer clothing, pockets and bags of those entering the premises are searched by a trained staff member of the same sex.
14. The Licence Holder and the Designated Premises Supervisor shall arrange adequate supervision of any queue, which may form to gain entry to the premises.
15. Clearly visible notices shall be displayed advising those attending that 1.It is a condition of entry that customers agree to be searched and 2.Police will be informed if anyone is found in possession of controlled substances or weapons.
16. No alcohol will be allowed to be taken into the event arena. Only alcohol bought inside the event arena can be consumed in this area.
17. The use of glass containers (including bottles) is not allowed. Beverages will be served in plastic or polycarbonate containers. No such containers are permitted to be removed from the event arena.
18. Responsible drinking is to be promoted at all bars and intoxicated people will be removed from the enclosure. All bar staff, volunteers and SIA personnel will be pre briefed on anti-social behaviour and responsible drinking practices.
19. Persons under 18 years of age will not be allowed upon the premises at any time the premises are operating without being under the supervision of a person aged 18 years and above.
20. Persons aged between 18 years to 21 years will not be allowed upon the premises at any time the premises are operating without being accompanied by a person aged 21 years and above.
21. An authorisation of sales, signed and dated by the DPS, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises. All staff involved in sales will be at least 18 years of age and will receive training to promote the licensing objectives. All training to be documented and records made available on request to any authorised officer.
22. In relation to the sale and service of alcohol, the licence holder and DPS are to support and rigorously enforce the Challenge 25 Proof of Age policy. Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: photo driving licence; passport; Proof of Age Standards Scheme Card. All staff involved in the supply of alcohol and all security staff to have received suitable training in relation to the Challenge 25 policy. All training to be documented and records made available on request to any authorised officer.
23. No adult will be served if suspected of attempting to purchase alcohol for anyone aged under 18 years.
24. Any advertisement and/or promotion for the Event will specify that a Challenge 25 Policy will be in place.
25. Frequent collection of drinking vessels will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises. Rubbish will be regularly cleared away to avoid any build up of waste.
26. There will be no adult/ sexual entertainment on the premises.
27. Any traders/ stall holders will complete an agreement stipulating that no adult products will be available for sale on the premises. The Organisers will regularly patrol the stalls selling products and ensure that stall holders remove any offensive goods/ material which are on display.
28. To not exceed the capacity limit of 3000 persons at any time (this includes all paid staff, volunteers and organisers)
29. A minimum of one personal licence holder at each outlet serving alcohol (in addition to the Designated Premises Supervisor) to be present at the designated outlet at the premises at all times during the duration of the Event.
30. Adequate numbers of trained first-aiders will be on the premises at all times the premises is open to the public.
31. Last time of entry to the premises will be 18.00 hours on each day the premises is open to the public
32. Last time of entry to the event arena will be 20.00 hours on each day the premises is open to the public.
33. The Event will be stewarded as per an agreed Stewarding Plan between the applicant and Lancashire Constabulary.
34. An incident book will be maintained, in which shall be recorded :
All incidents of crime and disorder
Refused sales to suspected under age / drunken persons
A record of any person refused admission or asked to leave the premises
Details of occasions upon which the Police are called to the premises
The use or discovery of drugs
35. That book shall be available for inspection by a Police Officer or authorised person.
36. The premises licence holder will operate clear ticket conditions, entry and eviction policies which will be documented and available on request to any authorised officer.
37. No content from live or recorded music will be offensive.
38. Risk assessments carried out by or on behalf of the Licence holder which relate to the licensing objectives will be available for inspection by a police officer or any authorised officer of a responsible authority.
39. The premises will operate a zero tolerance drugs policy.
40. A drugs prevention strategy for the venue shall be developed, applied and documented and available on request to any authorised officer.
41. Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
42. Regular patrolling by adequate numbers of trained personnel will take place at all times the premises is open to the public to ensure that all incidents of crime and disorder, drunkenness and anti-social behaviour are prevented and appropriately dealt with.
43. Random searches will take place to ensure that excessive quantities of alcohol are not being brought into the premises by ticket holders.
44. A full Event Safety Manual will be completed by the premises licence holder, forwarded to and agreed by all the responsible authorities by 23/08/10.
45. The Licence Holder will ensure authorised officers of Fylde Borough Council, in the course of their duties, shall have free access to all parts of the licensed site at all reasonable times for the purposes of supervision and enforcing the observance of the licensing objectives under the Licensing Act 2003 and other relative legislation.
46. The Licence Holder shall ensure compliance with all aspects of HSG 195- “The Event Safety Guide- The Guide to Health, Safety and Welfare at Music & Similar Events”, that are applicable to this event. The Licence Holder’s plan shall deal with the following issues:
a. Event Profile and overview;
b. Event Management Structure, chain of command, event management responsibilities (including overall responsibility for Health and Safety matters), Emergency Liaison Team;
c. Arena operation, facilities and attractions including main stages, arena operational method, sterile areas, and crowd control;
d. Public and employee safety including security and crowd management in all parts of the site. Both these aspects shall be documented in specific plans.
e. Major Incident Plan, including emergency vehicle routes, evacuation procedures and places of safety;
f. Site information including, but not limited to, fire safety, temporary structures, barriers, fencing, sanitary / washing and welfare facilities, lighting and electrical work, fuel storage and use;
g. Event Specific Risk Assessments and Health & Safety Policy including pre-, during and post -event;
h. Traffic Management Plan (including Public Rights of Way management);
i. Medical Services;
j. Cleaning Schedule;
k. Security & Stewarding Operations Plan;
l. Camping Management Plan;
m. Details of any special effects (e.g. pyrotechnics) and associated risk assessments;
47. An Event Safety Officer shall be established in order to provide a specific point of contact in relation to all matters pertaining to safety before, during and after the event. (This person must have the authorisation and ability to act unhindered on any issues relating to safety.)
48. At each entrance and exit on the licensed site, all those entering or leaving should be recorded to maintain an accurate attendance figure at any given time. The numbers from these counts are to be communicated hourly to the Licence Holder for collation.
49. The numbers of stewards and SIA-licensed staff shall be set out in the Security and Stewarding Operations Plan. The numbers of stewards/SIAlicensed staff employed throughout the duration of the event shall be in accordance with the plan.
50. All stewards and SIA licensed staff will have received a written statement of their duties and a site plan which will be signed for.
51. All stewards and SIA licensed staff will be trained in their duties prior to allowing members of the public onto the site to ensure they have a full understanding of the festival infrastructure and procedures.
52. A daily attendance register will be maintained and kept on site providing details of stewards and security personnel on duty at any time during this event to include start and finish times, full name, address and signatures.
53. The licence holder shall review and approve the working method statements and risk assessments of all suppliers and sub-contractors and make them readily available to Fylde Borough Council Health and Safety Team.
54. All electrical work will be controlled by a competent electrician and an electrical test certificate in accordance with IEE guidance will be provided to Fylde Borough Council Officers prior to the site being opened to the public.
55. All equipment which may be exposed to inclement weather or moisture shall be constructed and protected so as to prevent malfunction as a result of such exposure.
56. Any electrical equipment used in association with hand held devices, e.g. microphones, shall be protected by a miniature circuit breaker and also a residual current device (RCD) having a 30 mA tripping current and installed on a distribution board (not a plug-in type). The normal emergency lighting circuits should not be affected by the operation of an RCD.
57. LPG used for heating, cooking or lighting shall be of a fixed type installation stored outside any stall or vehicle and only cylinders using pressure relief valves shall be used. These should be positively secured in an upright position. All LPG installations shall comply fully with the requirements of the Health and Safety at Work etc. Act 1974 and all related Regulations and Code of Practice, in particular the Highly Flammable Gases and the Liquid Petroleum Gases Regulations 1972: SI 1972/917.
58. All LPG Cylinders not in use must be stored in the open air away from any fixed or temporary source of ignition and a suitable temporary hazard sign shall be placed at these locations.
59. The Licensee shall ensure that all temporary demountable structures including stages, marquees, barriers, grandstands, towers are built and installed by reputable suppliers in compliance with their own method statements and risk assessments and, where appropriate, in accordance with The Institution of Structural Engineers “Temporary Demountable Structures - Guidance on Design, Procurement and Use”, Second Edition 1999, or to any relevant guidance that supersedes this. All suppliers of temporary demountable structures will be required to supply sign off sheets for installations and structures supplied. All suppliers of temporary demountable structures will provide evidence of public liability insurance.
60. The maximum number of persons who may be in any identifiable part of the site, marquee, tent or temporary structure shall be determined by the Licence Holder and approved by the Health & Safety Team. The Licence Holder shall implement arrangements to monitor and control the number of persons in any such identifiable part of the site, marquee, tent or temporary structure to ensure that the maximum number is not exceeded.
61. All plant, machinery and items such as silage bales associated with the farm should be removed from the festival site and stored safely away from public access.
62. Provision to be made for emergency lighting to be in situ within enclosed structures before the site is open to the public and throughout the duration of the event for immediate use should an incident occur.
63. Adequate and appropriate artificial lighting will be provided throughout the site, including walkways throughout the event area, welfare facilities, car parks and camping areas and external to the site in areas where pedestrians can be expected to cross roads to gain access to the site.
64. Arrangements will be in place to re-instate lighting units that have failed to maintain a consistent level of lighting.
65. The camp sites will be divided into zones which will be filled sequentially to a density not exceeding 430 tents per hectare and to be supervised by stewards.
66. The Premises Licence Holder shall provide one drinking water point for every 500 tents in the campsite area.
67. The Licence Holder shall produce a Plan for the provision of toilet, water and washing facilities for both the camping areas and arenas. Sufficient facilities shall be provided to accommodate peak morning demand.
68. The Premises Licence Holder shall provide free wholesome drinking to a standard no less than is defined in Event Safety Guide (Guide to Health, Safety and Welfare at Pop Concerts and Similar Events) (Event Safety Guide HSG 195 2nd Edition 1999).
69. Water browsers or bottled water may be provided as an alternative with the consent of the Licensing Authority.
70. The Premises Licence Holder shall replenish the supply of wholesome water regularly so as to ensure that it is never exhausted.
71. All water points shall have:
· unobstructed access
· be clearly marked
· have self closing taps
· be clearly lit at night
a hard standing area or soak away to prevent the soil becoming muddy
72. Chemical Closets, where provided, shall be regularly and properly maintained and adequate provision shall be made for their emptying and cleaning, more often if necessary, taking into account periods of peak demand. Cleaning must occur in accordance with a schedule approved by Fylde Borough Council Health and Safety Team.
73. The Premises Licence Holder shall provide:
a. Hand wash facilities to the sanitary accommodation in the ratio of 1 to every 5 sanitary conveniences. (WC’s and Urinals).
b. Hand wash facilities with a supply of water and hand wash
c. If paper towel/roller towel units are provided as hand drying facilities, they shall be of commercial proportion to maximise towel provision. All such units must be subject to regular monitoring to ensure adequate replenishment of towel supplies.
d. Hand wash facilities in the sanitary conveniences supplied for Catering staff with a constant supply of hot and cold water, liquid soap discharged from an easy to use dispenser and disposable hand drying facilities. Adequate waste paper bins shall be provided.
74. The Premises Licence Holder shall make arrangements for the collection and disposal of refuse from all parts of the site.
75. The frequency of collection within each zone shall be proportional to the amount of refuse generated and subject to regular monitoring. Where particular areas within a zone are identified as generating large amounts of refuse, more frequent collections shall be arranged and, where necessary, additional collection operatives shall be drafted into collection teams.
76. The Premises Licence Holder shall ensure that operatives responsible for picking up/collection of refuse are trained and made aware of the hazards and to be provided with suitable personal protective equipment (gloves), (safety shoes), and sharps bins.
77. Each food stall shall be provided with a suitable covered refuse receptacle. The frequency of collection from each receptacle shall be based upon the amount of refuse generated and regular monitoring. Where particular stalls are found to generate large amounts of refuse, more frequent shall be arranged.
78. The Premises Licence Holder shall ensure that the level of the Medical and First Aid Provision shall be no less than that defined within Chapter 20 of the Event Safety Guide (Guide to Health, Safety and Welfare at Pop Concerts and Similar Events) (Event Safety Guide HSG 195 2nd Edition 1999).
79. A drinking water supply shall be provided at all first aid points.
80. The Premises Licence Holder must ensure that incidents are reported to the licensing authority in accordance with RIDDOR.
81. The Premises Licence Holder must ensure that suitable and sufficient liaison and communication arrangements should be established with the onsite medical provider to ensure the requisite information is supplied to the premises licence holder; to aid such compliance in respect of RIDDOR reporting.
82. The Premises Licence Holder shall ensure that they follow HSG 154 “Managing Crowd Safety- A Guide for Organisers, Events & Venues”.
83. The Premises Licence adopt the Mutamarq- Accredited Best Practice in “Safe Use & Operation of Marquees and Temporary Structures”.
84. The Chartered Institute of Environmental Health Officers (CIEH) National Guidance for Outdoor & Mobile Catering. ISBN 978-1-906989-29-3 details are to be followed by concessions and The Premises Licence Holder.
85. All amplified entertainment shall finish no later than 23.59
86. The concert shall be run in accordance with the Code of Practice on Environmental Noise Control at Concerts.
