ANNEX 1 - MANDATORY CONDITIONS
No supply of alcohol may be made under this licence
a. At a time when there is no designated premises supervisor in respect of it or,
b. At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended
Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence.
The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
The responsible person shall ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures
A responsible person is defined in S153(4) of the Licensing Act 2003 as:
(a) in relation to licensed premises-
(i) the holder of a premises licence in respect of the premises,
(ii) the designated premises supervisor (if any) under such a licence, or
(iii) any individual aged 18 or over who is authorised for the purposes of this section by such a holder or supervisor,
(b) in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables him to prevent the supply in question.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Children shall only be allowed into the restaurant when accompanied by an adult and will remain seated at the tables at all times.
Meals and substantial refreshment shall be available at all times the premises are open to the public.
Intoxicating liquor shall be sold or supplied only
a) to persons who are seated at tables and in addition to a meal
b) to persons who are waiting to be seated at a table.
c) which is ancilliary to a take away meal.
Off sales at the premises shall only be in sealed containers. Any unfinished bottles of wine must be recorked before being taken away from the premises.
The licence holder and the DPS are to support and rigorously enforce the Challenge 21 Proof of Age policy. Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: photo driving licence; passport; Proof of Age Standards Scheme Card; any other locally or nationally approved form of identification which may be introduced in the future.
All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this shall be made available to an authorised officer upon request.
Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
Suitable beverages other than intoxicating liquar (including drinking water) shall be equally available for consumption, with or otherwise ancillary to meals served in the licensed premises.
When regulated entertainment is taking place, all doors and windows shall be closed after 2200 hours except for access and egress.
All phone delivery orders for alcohol shall be ancilliary to food orders over £12.00.
Secure records will be kept for all alcohol deliveries including date/time, delivery address and name of purchaser.
CCTV shall be installed internally and externally at the premises and shall comply with the following criteria:
- The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of the Lancashire Constabulary. All public areas of the premises, with the exception of the toilets shall be covered by the system. The system shall incorporate a camera covering each of the entrance doors and shall be capable to providing an image which is regarded as identification standard.
- The system shall display on any recording the correct date and time of the recording.
- The system shall be recording during all hours the premises are open to the public.
- VCR tapes or digital recording shall be held for a minimum of 31 days and 28 days respectively after the recording is made and shall be made available to the Police or any authorised person acting for a Responsible Authority for inspection upon request.
- The system shall, as a minimum, record images of the head and shoulders of all persons entering the premises.
A staff member who is conversant with the operation of the CCTV system shall be on the premises at all times that the premises are open to the public. The staff member shall be able to show Police, or any officer acting for a Responsible Authority recent data or footage with the absolute minimum of delay when requested to a Police Officer or to a Local Authority Enforcement Officer.
The Licence Holder or Designated Premises Supervisor shall notify the Police Licensing Unit on any occasion when the CCTV is inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licensing conditions.
Appropriate signage alerting customers to CCTV recording shall be displayed in conspicuous positions on the premises.
Bi-annually documented maintenance checks of the CCTV system, including the recording system, shall be undertaken by the Designated Premises Supervisor to ensure the system is in good working order and fit for purpose.
