ANNEX 1 - MANDATORY CONDITIONS
No supply of alcohol may be made under this licence
a. at a time when there is no designated premises supervisor in respect of it or,
b. at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended
Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence.
The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
(1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
The responsible person shall ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures
A responsible person is defined in S153(4) of the Licensing Act 2003 as:
(a) in relation to licensed premises-
(i) the holder of a premises licence in respect of the premises,
(ii) the designated premises supervisor (if any) under such a licence, or
(iii) any individual aged 18 or over who is authorised for the purposes of this section by such a holder or supervisor,
(b) in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables him to prevent the supply in question.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The licence shall only have effect on the 23rd and 24th September 2011.
All risk assessments carried out by or on behalf of the Licence holder which relate to the licensing objectives shall be available for inspection by a police officer or any authorised officer of a responsible authority.
The Licence Holder shall ensure authorised officers of Fylde Borough Council, in the course of their duties, shall have free access to all parts of the licensed site at all reasonable times for the purposes of supervision and enforcing the observance of the licensing objectives under the Licensing Act 2003 and other relative legislation.
Alcohol shall only be sold or supplied to persons attending the event.
The use of glass containers (including bottles) shall not be permitted. Beverages shall be served in their cans or in plastic or polycarbonate containers.
Except for the purpose of delivery, no alcohol shall be allowed to be taken into the site. Only alcohol bought inside the site shall be allowed to be consumed within the site.
At least one personal licence holder shall be available on the licensed site while the supply or sale of alcohol is being undertaken (whose identity shall be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
A zero tolerance policy shall be adopted towards any illegal behaviour and any inappropriate behaviour shall be dealt with promptly and efficiently.
No entertainment of an adult nature shall take place on the site.
There shall be drinks other than intoxicating liquor (including drinking water) available at all times the site is open.
There shall be no drinks promotions which would contravene the British Beer and Pub Association Standards for the Management of Responsible Drinks Promotions, or which may encourage binge drinking.
Entry to the site shall only be permitted to those in possession of a valid security wristband.
An adequate number of licensed door supervisors and stewards shall be on duty as appropriate to any risk assessment, and shall not fall below that listed in the Event Plan.
Each individual at the site in order to carry out security activity must be licensed by the Security Industry Authority (SIA).
There shall be radio communication between all key personnel on site.
All SIA personnel, stewards and organisers shall wear a reflective jacket or tabard or armband of a design approved by the Lancashire Constabulary.
Where there is reasonable suspicion that drugs are being carried, the Licence Holder shall ensure that the outer clothing, pockets and bags of those entering the site are searched by a trained staff member of the same sex.
A clearly visible notice shall be displayed advising those attending that:
1. It is a condition of entry that customers agree to be searched and
2. Police shall be informed if anyone is found in possession of controlled substances or weapons.
Responsible drinking is to be promoted and drunken people shall be removed from the site. All bar staff, volunteers and SIA personnel shall be pre briefed on anti-social behaviour and responsible drinking practices.
All staff involved in sales shall be at least 18 years of age and shall receive training to promote the licensing objectives. All training to be documented and records made available on request to any authorised officer.
An incident book shall be maintained, in which shall be recorded.
All incidents of crime and disorder
Refused sales to suspected under age / drunken persons
A record of any person refused admission or asked to leave the site
Details of occasions upon which the Police are called to the site
The use or discovery of drugs.
That incident book shall be available for inspection by a Police Officer or authorised person.
The site shall operate a zero tolerance drugs policy.
A drugs prevention strategy for the venue shall be developed, applied and documented and available on request to any authorised officer.
Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
Regular patrolling by adequate numbers of trained personnel shall take place at all times the site is open to the public to ensure that all incidents of crime and disorder, drunkenness and anti-social behaviour are prevented and appropriately dealt with.
CCTV shall be in operation at the site at all times whilst licensable activities are taking place. The CCTV system shall be maintained and operated to the reasonable satisfaction of Lancashire Constabulary and shall cover at least at the entry/exit to the site and the main bar area.
A staff member who is conversant with the operation of the CCTV system shall be on the site at all times that the site are open to the public. This staff member shall be able to show police recent data or footage with the absolute minimum of delay when requested. This data or footage reproduction should be almost instantaneous.
Recordings shall be held for a minimum of 28 days after the recording is made and shall be available to the Police for inspection upon request.
A maximum capacity limit of 1500 persons (this includes all paid staff, volunteers and organisers) shall be permitted on the site at any time.
A suitable and sufficient risk assessment shall be undertaken having regard for the following:
i) A sufficient number of stewards shall be provided in relation to the estimated occupancy for the event.
ii) There shall be adequate provision of suitable located emergency exits within the perimeter fencing/barriers relating to the occupancy.
iii) Adequate provision and types of fire fighting equipment shall be provided in relation to the occupancy.
iv) An adequate number of first aiders and first aid equipment shall be provided in relation to the occupancy.
In relation to the event and the above issues the Premises Licence Holder shall follow the principles within The Event Safety Guide- A Guide To Health, Safety and Welfare At Music and Similar Events-HSG 195, Published by The Health and Safety Executive (HSE) 1999 ISBN 0 7176 2453.
Adequate numbers of trained first-aiders shall always be available on the site.
An Event Safety Officer shall be established in order to provide a specific point of contact in relation to all matters pertaining to safety before, during and after the event. (This person must have the authorisation and ability to act unhindered on any issues relating to safety.)
A designated member of the management team shall patrol the site ensuring that control measures identified within the risk assessments are implemented. Where there are new risks to safety identified, the designated person shall take the necessary steps reduce and eliminate such risks.
All electrical work shall be controlled by a competent electrician and an electrical test certificate in accordance with IEE guidance shall be provided to Fylde Borough Council Officers prior to the site being opened to the public
All equipment which may be exposed to inclement weather or moisture shall be constructed and protected so as to prevent malfunction as a result of such exposure.
Any electrical equipment used in association with hand held devices, e.g. microphones, shall be protected by a miniature circuit breaker and also a residual current device (RCD) having a 30 mA tripping current and installed on a distribution board (not a plug-in type). The normal emergency lighting circuits should not be affected by the operation of an RCD.
The Premises Licence Holder shall ensure that they follow HSG 154 Managing Crowd Safety- A Guide for Organisers, Events & Venues.
The event shall be run in accordance with the Code of Practice on Environmental Noise Control at Concerts.
The stage and amplifiers shall be positioned so that the best use is made of wind breaks to minimise the travel of sound.
A traffic control point shall be established on the site access road through which all vehicular traffic shall be monitored. Except for emergencies, all vehicular movement, by patrons, from or into, the site, shall be minimised before 8.00am and after 9.00pm.
A clear and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents, shall be erected and maintained in a prominent position.
Suitable and sufficient receptacles for refuse shall be provided and frequent collection of litter shall be undertaken to ensure that empty containers do not accumulate in or around the licensed area.
The licence holder and the DPS shall support and rigorously enforce the Challenge 25 Proof of Age policy. Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: photo driving licence; passport; Proof of Age Standards Scheme Card; any other locally or nationally approved form of identification which may be introduced in the future.
Persons under 18 years of age shall not be allowed upon the site at any time the site is operating without being under the supervision of a person aged 18 years and above.
No adult shall be served if suspected of attempting to purchase alcohol for anyone aged under 18 years.
Suitable signage shall be displayed in appropriate areas to specify that a Challenge 25 Policy shall be in place.
All staff involved in the sale or supply of alcohol shall have received suitable training in relation to the proof of age scheme to be applied upon the site. Records to evidence this shall be made available to an authorised officer upon request.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
A suitable and sufficient fire safety risk assessment should be undertaken and should be made available on the premises. The assessment should cover all significant risks, which may affect any person who may be affected by fire, and should include the means of access and egress from the premises. The assessment should be reviewed at regular intervals, and when a significant change is made
