ANNEX 1 - MANDATORY CONDITIONS
No supply of alcohol may be made under this licence
a. at a time when there is no designated premises supervisor in respect of it or,
b. at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended
Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence.
1.-(1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
2. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
3. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
4.-(1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
5. The responsible person shall ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures
A responsible person is defined in S153(4) of the Licensing Act 2003 as:
(a) in relation to licensed premises-
(i) the holder of a premises licence in respect of the premises,
(ii) the designated premises supervisor (if any) under such a licence, or
(iii) any individual aged 18 or over who is authorised for the purposes of this section by such a holder or supervisor,
(b) in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables him to prevent the supply in question.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
A Personal Licence Holder shall be available at all times.
An adequate number of licensed door supervisors shall be on duty as appropriate to any risk assessment
A zero tolerance policy in relation to drugs shall be adopted and should the sale or use of drugs be discovered the Police shall be informed.
Security shall be on site 24 hours a day.
Adequate first aid provision shall be available at all times.
Fire extinguishers shall be provided at the premises.
A fire emergency evacuation plan shall be developed and briefed to staff.
Any draught beer shall be sold in plastic glasses.
Prominent notices shall be at the premises requesting patrons to respect residents privacy.
An adequate number of toilets shall be provided.
Bottle bins shall not be emptied after 2200 hours.
All waste shall be covered to prevent rodent infestation.
All persons under 18 must be accompanied by a responsible adult after 2200 hours.
No gaming machines shall be provided at the premises.
Staff shall be trained to adopt a Challenge 25 policy.
No entertainment of a sexual or adult nature shall take place on the premises.
Drinks will be served in toughened glass or polycarbonate vessels only in order to prevent glass related incidents.
Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
Risk assessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.
Records of incidents involving the use and / or detection of drugs shall be maintained and those records shall be available for inspection. Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
Alcohol shall only be sold or supplied to persons attending the event. Except for the purpose of delivery, no alcohol shall be allowed to be taken into the site. Only alcohol bought inside the site shall be allowed to be consumed within the site. Signage shall be clearly displayed at the entrances to the site to this effect.
A clearly visible notice shall be displayed advising those attending that:
a. Alcohol can not be brought on site
b. It is a condition of entry that customers agree to be searched and
c. Police shall be informed if anyone is found in possession of controlled substances or weapons.
In relation to any event the Premises Licence Holder shall follow the principles within The Event Safety Guide - A Guide to Health, Safety and Welfare At Music and Similar Events - HSG 195, Published by the Health and Safety Executive (HSE) 1999 ISBN 0 7176 2453
The licence holder and the DPS shall support and rigorously enforce the Challenge 25 Proof of Age policy. Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: photo driving licence; passport; Proof of Age Standards Scheme Card; any other locally or nationally approved form of identification which may be introduced in the future.
Suitable signage shall be displayed in appropriate areas to specify that a Challenge 25 Policy shall be in place.
All staff involved in the sale or supply of alcohol shall have received suitable training in relation to the proof of age scheme to be applied upon the site. Records to evidence this shall be made available to an authorised officer upon request. Staff will also be briefed on responsible drinking practices.
